Luzerne County courts handled more cases, brought less revenue

Luzerne County courts handled more cases last year but saw less court-related revenue returned to the county than in 2011, according to statistics released Tuesday by the state Supreme Court.

The county's Court of Common Pleas and magisterial district courts handled 71,236 total cases in 2012, up 1,454 from 69,782 in 2011.

The total amount of fees, fines, costs and restitution disbursed to the county government, however, dipped to $9,732,879 from $9,862,776 in 2011 - a reduction of $129,897.

Magisterial district and common pleas criminal courts throughout the state collected and disbursed to the state, counties, municipalities and victims a total of $469 million last year, according to the state Supreme Court's statistics.

"Although the judiciary's fundamental function is the delivery of fair, timely and accessible justice, the collection of court-ordered financial sanctions is important, not just in terms of dollars but also in restoring victims' lives and in enforcing the rule of law," Chief Justice Ronald D. Castille said in a statement.

Luzerne County court officials were unclear Tuesday on the reason for the increase in caseload and the drop in disbursements to the county.

Most of the increased caseload, an additional 988 cases, came at the magistrate level, which handles traffic tickets, summary offenses and small-claims civil complaints in addition to arraignments and preliminary hearings for criminal cases. The Court of Common Pleas, which handles misdemeanor and felony criminal cases, saw an increase of 466 cases in 2012 over 2011.

Statewide, courts saw a 4 percent drop in case filings from last year and a $643,175 drop in disbursements. Over the last five years, courts statewide saw a nearly 13 percent drop in cases, from more than 3 million to 2.6 million.

Approximately two-thirds of the decline, the state Supreme Court said, was due to a significant drop in the number of traffic citations issued throughout the state, reducing funding to a number of state and local programs and causing an 18 percent decline in funds deposited into a fund for court automation.

Luzerne County followed the trend in dropping traffic citation drops, going from a five-year high of 42,969 tickets in 2008 to a five-year low of 38,416 in 2011. That figure increased slightly in 2012, to 39,566.

Lackawanna County receives $7.5 million in court money

County's share of state court costs at $7.5M

Lackawanna County received $7.5 million from the Pennsylvania court system in 2012 from fees, fines, court costs and restitution collected by the state.

The allotment is up from $6.9 million in 2011, despite a slight drop in the number of court cases filed in the county. In 2012, 40,449 court cases were filed in Lackawanna County, down from 41,325 filed last year, according to a news release from the Supreme Court of Pennsylvania on Tuesday.

Despite a 4 percent drop in the court case filings across the state last year, the Pennsylvania magisterial district and common pleas court systems distributed $469 million from collections last year to the state, counties, municipalities and victims.

The courts attribute some of the decline in cases across the state to a drop in the number of traffic citations issued.

More than $211 million was distributed to the state, $165 million was divided among counties, $52 million divided among municipalities, $36 million was paid to crime victims for restitution and a small portion was given to schools, libraries and tax agencies collections, according to the release.

Much of the money redistributed to the state goes into specific funds such as the motor license fund, while a small chunk goes into the Judicial Computer System Account to support courtwide automation.

Police Report Highlights

OLD FORGE POLICE: Officers responded to more than 15 calls between Feb. 10-16.

On Feb. 10, officers were dispatched to assist Taylor police with a call on Kennedy Boulevard.

On Feb. 11, officers were dispatched to investigate a report of a suspicious vehicle in the 100 block of Ray Street. A report of a 911 hang-up call sent officers to the 500 block of Kholer Avenue. Officers also assisted emergency medical services (EMS) with a call in the 100 block of Taroli Street.

On Feb. 12, officers were dispatched to assist EMS with a fall victim in the 100 block of Sussex Street.

On Feb. 13, officers were dispatched to investigate a reported domestic dispute in a home in the 400 block of Melmore Street. A reported assault sent officers to the 200 block of Mary Street. Officers also responded to investigate a motor vehicle accident at the intersection of West Grace and Edith streets.

On Feb. 12, officers were dispatched to a home in the 300 block of West Taylor Street to investigate a report of child abuse. A trespassing complaint sent officers to the 100 block of Colon Court. Officers also responded to investigate a retail theft complaint at the Walmart on Main Street.

On Feb. 13, officers responded to investigate a motor vehicle accident in the 200 block of Tamworth Drive. A retail theft complaint sent officers to the Walmart on Main Street. Officers also responded to the Turkey Hill on Keyser Avenue to investigate a report of disorderly men causing a disturbance.

On Feb. 14, officers were dispatched to investigate a motor vehicle accident in the 700 block of South Main Street. A 911 hang-up call sent officers to the 400 block of South Main Street.

On Feb. 15, officers were dispatched to investigate a fraud complaint in the 200 block of West Taylor Street. A reported fire sent officers to the 300 block of Church Street. Officers were dispatched to investigate a dispute between neighbors in the 100 block of Storrs Street.

Retail theft

COAL TOWNSHIP - Brandie Dietrich, 20, of 213 S. Poplar St., Mount Carmel, and a 16-year-old female from Ashland have been charged by Patrolman Christopher Lapotsky with retail theft for concealing $112.23 worth of merchandise at Wal-Mart Supercenter on Route 61 and leaving the store without paying for the items Dec. 24.

Police said Deitrich and the teen were apprehended by security personnel in the store parking lot.

Student charged

COAL TOWNSHIP - A 16-year-old male from Coal Township has been charged by Patrolman Christopher Lapotsky with harassment relating to a Feb. 7 disturbance at Shamokin Area Middle/Senior High School.

Police said the student threatened to punch a teacher and made obscene and lewd remarks toward the teacher in the classroom.

Heater/fan stolen

COAL TOWNSHIP - Phillip Bilbay, 38, of 1039 W. Water St., Coal Township, told police someone entered his 1998 Chevy Cavalier and removed a 12-volt heater/fan valued at $30.

Police said the theft occurred Saturday or Sunday.

Anyone with information about the incident is urged to call Coal Township police at 644-0333.

Car hits pole

LOWER MAHANOY TOWNSHIP - Daniel D. Bixler, 47, of Herndon, escaped injury Tuesday when his car struck a utility pole and ditch along Route 147 west of Mountain Road.

State police at Stonington reported Bixler was driving a 2001 Buick Century north at 5:30 p.m. when his vehicle exited the highway and traveled onto the shoulder, where it struck a utility pole with its left front end. The car then continued to travel north and hit a ditch with its front end before spinning and stopping.

Car crash

SNYDERTOWN - Miriam E. Fultz, 49, of Sunbury, and her passenger, Renee S. George, 23, of Snydertown, were not injured Tuesday in a weather-related accident along Snydertown Road near Kampco Industries.

State police at Stonington said Fultz was driving a 2010 Toyota Corolla west at 11:49 a.m. when she lost control of the car on the snow-covered road, causing Corolla to strike guard rail.

Driver injured

MONROE TOWNSHIP - Chelsie L. Radel, 21, of Sunbury, was transported by ambulance to Geisinger Medical Center in Danville after a one-vehicle accident Tuesday at the intersection of Mill Road and Penns Drive in this Snyder County township.

According to state police at Selinsgrove, Radel was driving a 2010 Nissan Sentra west on Mill Road at 1:41 p.m. when the car traveled off the road and descended an embankment while she was negotiating a curve.

The vehicle was towed from the scene.

Police said the crash remains under investigation.

No injuries

WHITE DEER TOWNSHIP - Alicia Riley, 22, of Elysburg, and a 1-year-old male passenger from Elysburg escaped injury shortly after 6 p.m. Tuesday when Riley lost control of the vehicle she was driving east on New Columbia Road in this Union County township. The vehicle left the road and hit several small trees.

State police at Milton reported Riley's vehicle was towed from the scene.

Fatal crash

UPPER PAXTON TOWNSHIP - State police at Lykens reported Lorena Lemons, 70, of Millersburg, died from injuries sustained in a head-on crash Tuesday morning along Route 147 near Elmer Avenue in this Dauphin County township.

Police said Lemons was operating a 2006 Ford Escape that collided head-on with a 2004 Nissan Titan truck operated by Justin Wallace, 30, of Millersburg.

Lemons was transported to Harrisburg Hospital, where she died. Wallace, who suffered moderate injuries, was transported to Hershey Medical Center, where he underwent emergency room treatment.

Both vehicles were demolished in the 11:30 a.m. accident.

Vehicle rolled

WEST CHILLISQUAQUE TOWNSHIP - Ashley L. London, 23, of Lewisburg, suffered moderate injuries Tuesday morning when the 2010 Chevrolet Cobalt she was driving left Route 405, struck a wooden post, rolled and landed on its roof in Mindy's Tavern parking lot.

State police at Milton reported London was traveling south at about 9 a.m. when she lost control of the vehicle while negotiating a left curve, causing the Cobalt to exit the right side of the road.

London, who was cited for driving at an unsafe speed, was transported by William Cameron Ambulance to Evangelical Community Hospital in Lewisburg.

Charges pending

DANVILLE - Assault charges are pending against a 21-year-old Harrisburg woman who is a patient at Danville State Hospital in connection with two incidents that occurred Tuesday afternoon at the state hospital.

State police at Milton reported the patient was allegedly involved in a physical altercation with staff members at 3:15 p.m. and kicked staff member Susan Zimmerman, 52, of Ashland, in the groin area while Zimmerman was attempting to calm her down.

Police said the same patient also allegedly struck staff member Vicki Williams, 39, of New Columbia, in the wrist and spit in her face at 5 p.m.

Police did not identify the suspect.

DUI charges

The following people were recently charged with driving while under the influence in Bradford County:

Dean A. Brockoff, 48, of Lockwood, N.Y., by Sayre borough police, on Feb. 19, on Spring Street in Sayre. Brockoff has also been charged with possession of a controlled substance, driving under the influence of a controlled substance and possession of drug paraphernalia. Police said officers believed Brockoff to be under the influence of bath salts at the time of his arrest. Brockoff was arraigned Feb. 19 by Magisterial District Judge Jonathan Wilcox and remanded to the Bradford County Jail in lieu of $55,000 bail. Brockoff's preliminary hearing is scheduled for Feb. 26.

Sean Edward Seifert, 27, of Winnemucca, Nev., by Athens Township police, on Feb. 16, on Weaver Road in Athens Township. Seifert has also been charged with carrying a firearm without a license. Seifert was arraigned Feb. 16 and remanded to the Bradford County Jail in lieu of $100,000 bail. Seifert's preliminary hearing is scheduled for Feb. 26.

Man charged with drug possession

A Waverly man was recently arrested by Athens Township police on a charge of possession of a controlled substance.

According to papers filed with Magisterial District Judge Michael Shaw, Nicholas S. Campbell, 28, was also charged with retail theft.

Police said Campbell removed fishing lures Feb. 8 from the Walmart on Elmira Street. The lures were valued at $80.12, police said. A search of Campbell following his arrest turned up tramadol and morphine pills for which Campbell had no prescription, police said.

Campbell's preliminary hearing is scheduled for March 19.

Police investigate Smithfield Twp. scam

State police at Towanda are investigating a telephone scam that occurred Feb. 16 in Smithfield Township.

According to information from state police, a male called an 82-year-old female victim and told her she would receive a vehicle and $2.5 million if she sent him $2,000. Police said the woman purchased money cards in Athens Borough, and clerks at the store alerted police about the suspected scam.

Police arrived to find the victim on the telephone with the man coordinating the money exchange and advised her not to give out any card numbers over the phone, police said.

State police would like to remind everyone that calls to send money and receive money in return are likely scams. Do not give out card numbers, social security information or other personal information over the telephone, police said.

Police investigate sexual assault

State police at Towanda are investigating a sexual assault that occurred in Sayre Borough.

According to information from state police, a nine-year-old female juvenile was allegedly assaulted at a borough location between 2003 and 2007. Police continue to investigate the report.

Signs stolen

State police at Towanda are investigating the theft of two signs from a Smithfield Township location.

According to state police information, an unknown actor removed two "No Trespassing" signs from a field on Springfield Road between 2 and 4 p.m. Feb. 17. Anyone with information is asked to contact state police at (570) 265-2186.

Troy man arrested for theft of motor vehicle

Derek Baldwin, 34, of Troy was recently arrested on a warrant for the theft of a motor vehicle, police said.

Sate police said that Baldwin was operating the vehicle at 1:45 p.m. on Feb. 8 when they pulled it over along Marcy Hill Road in Monroe Township.

The vehicle belongs to a 45-year-old Troy man, according to the state police at Towanda.

Towanda woman cited with harassment

Karen Sue Hall of Towanda went to the Metadyne plant in Towanda Township and struck a 22-year-old female employee in the head with a cane, police said.

Hall, 46, has been cited with harassment as a result of this incident, which occurred at 11:03 p.m. on Feb. 13, state police at Towanda said.

Rome teen charged with making false report to police

A 17-year-old Rome boy has been charged with false reports to law enforcement authorities, police said.

The teenager had contacted the state police at Towanda on Jan. 25 and told them that a Hispanic male had tried to carjack his vehicle at gunpoint, police said.

The teenager told the police that he gave the Hispanic male his money and fled the scene, according to the state police.

Later, the teenager confessed to the police that he made up the story and had actually given his money to someone he knew, to whom he owed money, police said.

DUI charge:

Michael Joseph Stonier, 28, of Hunlock Creek, Pa., by the state police, on Feb. 5, on state Route 487 in Colley Township. A test revealed that the amount of alcohol in Stonier's blood was above the legal limit on the day of his arrest.

One hurt

UPPER AUGUSTA TOWNSHIP - A Reading woman suffered moderate injuries in a crash at 5:20 a.m. Friday on Route 61 near Hill Street.

State police at Stonington said a Ford Explorer, driven by Cynthia Lou Curry, 55, of 624 Thorn St., was traveling north on Route 61 when the vehicle exited the south side of the road and hit a tree.

Curry suffered moderate injuries and was transported to Evangelical Community Hospital, Lewisburg, for treatment. Police said Curry will be cited for the crash.

Assisting police at the scene were Americus Hose Company Ambulance, Upper Augusta Fire Department, Sunbury Ambulance and the Sunbury Fire Department.

DUI

MARION HEIGHTS - Crystal A. Kerner, 26, of 249 S. Spruce St., was charged with driving under the influence, driving with a suspended license and driving on roadways laned for traffic following a Jan. 27 traffic stop on Park Road.

Mount Carmel Township Police Patrolman Kelly Campbell filed the charges following the 3:27 a.m. stop when chemical testing showed Kerner was under the influence of a combination of alcohol along with traces of THC, the chemical found in marijuana.

The charges were filed with Magisterial District Judge Hugh Jones, of Mount Carmel, with a preliminary hearing set for Wednesday, March 20.

Hit and run

SHAMOKIN - City police are attempting to locate a vehicle involved in a hit-and-run crash at about 9 p.m. Wednesday on Bear Valley Avenue.

Police say a motorist struck two vehicles in the 600 block of Bear Valley Avenue and continued either south on Route 125 towards Gowen City or through the second patch on Bear Valley Road in Coal Township.

The suspect vehicle is described as a white pickup truck with toolboxes mounted on the truck's side rails, and should have moderate damage to the front passenger side.

Anyone with information should call police at 648-5708.

PFA violation

KULPMONT - Leroy J. Manhart, 43, of 475 High Road, Ashland, was charged by Kulpmont Borough Police with indirect criminal contempt for violating a protection from abuse order on Dec. 15 at the Timberwood Park Apartments.

Patrolman Joshua Pustucka reported in court documents that Manhart allegedly contacted Shirley Derr. Manhart is not supposed to have contact with Derr because her daughter, Rebecca, has a PFA order against him.

A hearing before the Northumberland County Court of Common Pleas will be scheduled at a later date.

DUI

MOUNT CARMEL - Mount Carmel Township police Chief Brian Hollenbush charged Brian K. Howerter, 48, of 215 W. Saylor St., Atlas, with driving under the influence of a controlled substance, driving under the influence of a drug or a combination of drugs, driving on the right side of the roadway following a traffic stop at 2:26 p.m. on Jan. 11 in the area of Laurel and Wood streets, Mount Carmel Township.

According to chemical testing, Howerter's blood was found to have traces of eight different drugs, including marijuana, fentanyl and other prescription medication.

The charges were filed with Magisterial District Judge Hugh Jones, of Mount Carmel, and a preliminary hearing is set for March 20 before Jones.

DUI

MOUNT CARMEL - James E. Doak, 44, of 31 N. Locust St., was charged driving under the influence, driving with a suspended license and careless driving following a traffic stop on Second and Locust streets at 1:30 a.m. Dec. 30.

According to court documents filed by Mount Carmel Borough Police Patrolman Shane Reamer, Doak was discovered when the front tires of his vehicle became stuck on a four-foot high snow bank. According to chemical testing taken at Geisinger-Shamokin Area Community Hospital, Doak blood alcohol level at the time was .226 percent, which is above the .08 legal limit.

The charges were filed with Magisterial District Judge Hugh Jones, of Mount Carmel. A preliminary hearing is set for Wednesday, March 20.

Alcohol citation

KULPMONT - Borough police cited Robert Santore, 50, of 217 E. Third St., Ranshaw, with restrictions on alcoholic beverages following an incident in the 1400 block of Chestnut Street at 2:15 a.m. Feb. 11.

Kulpmont Police Patrolman Shane Reamer reported Santore was a passenger in a vehicle that was stopped by police. Santore was allegedly holding a plastic cup that contained vodka and had an open can of beer on the floor between his feet, police said.

DUI

KULPMONT - Borough Police Patrolman Joshua Pastucka charged Dennis J. Cousentino, 44, of 1435 Chestnut St., with driving under the influence, driving with an expired registration and without a proper registration card following a traffic stop in front of Cousentino's residence at 2:52 a.m. Feb. 4.

According to court documents, Cousentino allegedly failed field sobriety tests and refused to submit to chemical blood testing.

The charges were filed with Magisterial District Judge Hugh Jones, of Mount Carmel. A preliminary hearing is set for March 20.

Prisoner charged

COAL TOWNSHIP - Luther L. McNeil Jr., 22, an inmate at SCI-Coal Township, was charged with aggravated harassment by a prisoner following an incident at the facilty at 12:10 p.m. Feb. 4.

According to court documents, Pennsylvania State Police Trooper David Myers reported McNeil allegedly threw a cup of liquid, suspected to be urine, at correctional officer James Heistand while the officer was retrieving McNeil's food tray. The liquid struck Heistand's face, neck and upper torso.

The charges were filed with Magisterial District Judge John Gembic III, of Shamokin.

Drug paraphernalia

COAL TOWNSHIP - Nicole L. Bower, 27, of 1344 Hosta Road, Paxinos, was charged with possession of drug paraphernalia following an incident in the Anthra Plaza parking lot at 3:59 p.m. Oct. 8.

Police Det. Jeffrey Brennan filed the charges after Bower was found passed out in a vehicle parked in the plaza with syringes visibly laying around her. While she was being treated at an emergency room, police searched a small case she had with her, finding four empty wrappers commonly used to package heroin.

The charges were filed with Magisterial District Judge John Gembic III, of Shamokin.

Retail theft

COAL TOWNSHIP - Brandie M. Dietrich, 20, of 213 S. Poplar St., Mount Carmel, was charged with retail theft by Coal Township Police Patrolman Chris Lapotsky following a Dec. 24 incident when she and another female allegedly removed $112.23 of merchandise from the Wal-Mart SuperCenter store without paying for the items.

DUI

TREVORTON - State police at Stonington charged Marie T. Mielke, 29, of 106 W. Shamokin St., Trevorton, with driving under the influence and a variety of traffic violation following a stop on Coal Street near Fourth Street in Zerbe Township Dec. 6.

Police said Mielke was stopped for driving a vehicle with a non-operational headlight and an expired license plate sticker. When stopped, Mielke allegedly could not locate her license and vehicle registration. She later failed a field sobriety test and preliminary breath test and placed in custody for chemical blood testing, which produced a result that her blood alcohol level of .091 percent.

The charges were filed with Magisterial District Judge John Gembic III, of Shamokin.

Disorderly conduct

HUMMELS WHARF - Nathan Leonard, 40, of Shamokin, was charged with disorderly conduct following an incident at 11:40 a.m. Friday at the MedExpress Urgent Care Center, on North Susquehanna Trail.

State police at Selingsgrove said Leonard became argumentative with a doctor and kicked open a door.

LOWER MAHANOY TOWNSHIP - A Dalmatia teen was not injured in a one-vehicle accident Friday afternoon on Middle Road west of Route 225, according to state police at Stonington.

Trooper David Townsend said a 17-year-old male was traveling west on Middle Road in a 2003 Subaru Impreza at 2:50 p.m. Friday when the car traveled off the roadway to the right and struck a fence and then a tree.

The driver was wearing his seatbelt, and he will be cited for a traffic violation, police said.

Driver hurt

UPPER AUGUSTA TOWNSHIP - A Sunbury driver sustained moderate injury Friday night in a one-vehicle accident on Route 61 near Haas Manor Road, according to state police at Stonington.

Trooper James Yankovich said Dustin L. Bell, 37, was driving a 2009 Pontiac G6 at 8:03 p.m. Friday north on Route 61 when the car exited the right side of the roadway and traveled 25 feet before striking a utility police and three mailboxes.

The vehicle rolled and landed on its roof facing south, police said.

Bell was not wearing his seatbelt. He was transported from the scene by AREA Services to Geisinger Medical Center, Danville.

Part of the highway was closed for approximately 90 minutes.

One driver injured

LOWER MAHANOY TOWNSHIP - A Herndon driver was injured and a Sunbury driver escaped harm in a two-vehicle accident Thursday afternoon on Route 147 at its intersection with Sunbury Street, according to state police at Stonington.

Trooper Todd Leiby said Christian H. Heimbach, 21, of Sunbury, was traveling south at 1:40 p.m. in a 2002 Chevrolet Silverado through the village of Dalmatia when Jessica L. Reiner, 24, of Herndon, driving a 2002 Kia Sportage, traveled into the path of Heimbach from a stopped position on Sunbury Street.

Both drivers were wearing their seatbelts, and Reiner had an injury of unknown severity, police said.

Driver suffers moderate injuries

LITTLE MAHANOY TOWNSHIP - A 17-year-old Sunbury driver experienced moderate injuries in a one-vehicle accident Saturday night at the intersection of Route 225 and State Road, according to state police at Stonington.

Trooper David Myers reported that the teen was driving in a 1999 Mazda B2500 at 11:07 p.m. Saturday south on Route 225 when he lost control of the vehicle.

The vehicle traveled off the roadway into a ditch, where it came to a final rest, and sustained disabling damage to the front driver side that it had to be towed by Troy's Towing, police said.

The teen was wearing his seatbelt, but was transported by Trevorton Ambulance to Evangelical Community Hospital, Lewisburg, police said.

The driver was cited for a traffic violation, police said.

In addition to state police and ambulances, the responding units included Trevorton Fire Department and Herndon Community Fire Company.

Shamokin driver escapes injuries

SHAMOKIN TOWNSHIP - A Shamokin driver escaped injuries Saturday afternoon in a one-vehicle accident on Route 61, 295 feet north of Irish Valley Road, according to state police at Stonington.

Trooper David Myers reported that Micheline A. Santor, 51, was traveling south on Route 61 in a 2011 Jeep Compass at 2:42 p.m. Saturday when she veered off the roadway and struck a guardrail.

The Jeep sustained disabling damage to the front passenger side and was towed by Zlocki's Body Works, Marion Heights, police said.

Santor was wearing her seatbelt, and she was cited with a traffic violation, police said.

No injuries in one-vehicle crash

EAST CAMERON TOWNSHIP - A Mount Carmel driver escaped injuries Friday night in a one-vehicle accident on Route 2044, according to state police at Stonington.

Trooper David Townsend reported that Maria C. Bressi, 27, was traveling west on Upper Road in a 2011 Toyota Prius when she lost control and struck a stone wall and a snow bank.

The car came to final rest on the right berm, facing south, against a stone wall, police said.

Bressi was wearing a seatbelt, and she was cited with a traffic violation, police said.
